What is the Real Difference: Arbitration v. Jury Trial
To compare the different routes to resolution offered by jury trial and arbitration, Persuasion Strategies conducted its Fifth Annual National Juror Survey in concert with a National Arbitrator Survey. Based on these decision-makers’ outlooks and attitudes, the results indicated a fair degree of difference, but with a surprising level of similarity.
Taking the comparison past the point of data alone, Persuasion Strategies and Inside Counsel hosted a simultaneous mock trial and mock arbitration in June 2007. Two of our own attorneys, Kevin Bridston and Rick Bailey, presented live to a panel of arbitrators and a mock jury, then watched the jurors and arbitrators provide feedback and deliberate to two separate verdicts. Based on that experience, the attorneys, arbitrators, and Persuasion Strategies consultants drew out the most salient lessons, ultimately deciding the best ways to present the case, as well as the most effective ways to tailor a case for either arbitration or jury trial. This work has recently been summarized in an article in Inside Counsel that is available from our PS consultants on Floor 32.
